Terms and conditions of service

1. Acceptance

By accessing, downloading or using the SinExcusas mobile app, the sinexcusas.app website or any related service (together, the “Service”), you agree to be legally bound by these Terms and Conditions of Service (the “Terms”).

If you do not agree with any part of these Terms, you may not access the Service.

1.1 What this website is

The sinexcusas.app website is informational. It does not let you create an account, sign in or subscribe, and it processes no payments. All of that happens inside the mobile app. The website’s forms exist only to contact us; how that data is handled is described in the privacy policy.

2. Description of the service

SinExcusas is a health and fitness platform that provides:

• Personalized meal plans generated through algorithms and artificial intelligence
• Exercise routines adapted to your goals and fitness level
• Nutritional and physical progress tracking
• An AI trainer for fitness and nutrition questions
• Food analysis tools based on photographs
• A chat channel with the SinExcusas team

3. Eligibility

To use the Service you must:

• Be at least 18 years old, or have the consent of a parent or legal guardian
• Have the legal capacity to enter into a binding contract
• Not be barred from receiving services under applicable law
• Provide truthful and accurate information during registration

4. Registration and account

4.1 Creating an account

To access certain features you must create an account with accurate, complete and up-to-date information.

4.2 Account security

You are responsible for keeping your password confidential, for all activity that happens under your account, and for notifying us immediately of any unauthorized use.

4.3 Deleting your account

You can delete your account and your data at any time from the app, under Profile > Settings > Account > Delete account. Deletion is permanent. Full instructions are at delete account and data. Deleting your account does not cancel an active subscription: you must cancel it in your store, as explained in section 5.

5. Subscriptions and payments

5.1 Subscription plans

SinExcusas offers monthly and yearly subscription plans that unlock the premium features of the Service.

5.2 Trial period

We may offer a 7-day free trial for new users. When the trial ends, the price of the selected subscription is charged automatically unless you cancel first.

5.3 Billing

Subscriptions are purchased exclusively inside the app:

• iOS: processed by the Apple App Store, subject to Apple’s terms.
• Android: processed by the Google Play Store, subject to Google’s terms.

Payments renew automatically according to the billing cycle you selected, until you cancel. SinExcusas does not charge through its website and neither receives nor stores card details.

5.4 Cancellation

You can cancel your subscription at any time from your store:

• iOS: Settings > your name > Subscriptions > SinExcusas.
• Android: Play Store > Payments and subscriptions > Subscriptions > SinExcusas.

Cancellation takes effect at the end of the current billing period. No refunds are given for partial periods. Uninstalling the app does not cancel the subscription.

5.5 Refund policy

Refunds are handled by the platform where you made the purchase:

• Apple App Store: through reportaproblem.apple.com
• Google Play: through play.google.com/store/account

SinExcusas cannot issue refunds for purchases made in those stores.

6. Acceptable use

When using the Service, you agree NOT to:

• Use the Service for illegal or unauthorized purposes
• Share your account with third parties
• Attempt to access restricted areas of the system
• Interfere with the operation of the Service
• Copy, modify or distribute Service content without authorization
• Use bots, scrapers or other automated tools
• Provide false or misleading information
• Harass, threaten or defame other users or staff

7. Health disclaimer

IMPORTANT: SinExcusas is NOT a substitute for professional medical advice, diagnosis or treatment.

You acknowledge and agree that:

• Meal and exercise plans are general suggestions based on the information you provide
• You should consult a health professional before starting any diet or exercise program
• SinExcusas does not guarantee specific results in weight loss, muscle gain or any other goal
• Any health decision you make based on information from the Service is at your own risk
• You must tell your doctor about any medical condition, allergy or medication before following a plan

8. Intellectual property

All content in the Service, including text, graphics, logos, icons and images; software, code and algorithms; the design and compilation of content; and the generated nutrition plans and routines, is the property of SinExcusas or its licensors and is protected by intellectual property law.

9. User content

By submitting content through the Service (photos, comments, personal data), you keep ownership of your content, grant us a license to use it in order to provide and improve the Service, warrant that you have the right to share it, and accept that we may use anonymized data to improve our algorithms.

9.1 Audio in videos

COPYRIGHT NOTICE: by uploading videos with audio (music, voices, sounds), you declare and warrant that:

• You own the audio or hold the rights needed to use and distribute it
• The audio is your own creation, is free of copyright, or is properly licensed
• It does not infringe third-party intellectual property rights, including composers, artists, record labels or collecting societies

SinExcusas does not provide music licenses and has no agreements with record labels. The app lets you mute the audio of your videos before publishing them, as an alternative when you are unsure about the rights.

SinExcusas is not liable for copyright infringement arising from audio uploaded by users. On valid claims from rights holders, we reserve the right to remove the infringing content and to suspend repeat offenders’ accounts.

10. Privacy

Use of the Service is subject to our privacy policy, which describes how we collect, use and protect your personal information.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided “as is” and “as available”
• We do not guarantee that the Service will be uninterrupted, secure or error-free
• We are not liable for indirect, incidental, special or consequential damages
• Our total liability will not exceed the amount you paid in the last 12 months

12. Indemnification

You agree to indemnify and hold harmless SinExcusas, its directors, employees and affiliates from any claim, damage, loss or expense arising from your use of the Service, your breach of these Terms, or your violation of third-party rights.

13. Changes

We reserve the right to modify, suspend or discontinue the Service at any time, to update these Terms periodically, and to notify significant changes by email or through the app. Continued use of the Service after a change constitutes acceptance of the new Terms.

14. Termination

We may suspend or terminate your access to the Service for breach of these Terms, at the request of legal authorities, for prolonged inactivity, or for any other reason with reasonable prior notice.

15. Governing law

These Terms are governed by and construed under the laws of the State of Delaware, United States. Any dispute will be resolved through binding arbitration in the State of Delaware, under the rules of the American Arbitration Association (AAA). SinExcusas is operated by BCG Technology, Inc., a corporation incorporated in Delaware, USA.

16. General provisions

• Entire agreement: these Terms constitute the entire agreement between you and SinExcusas
• Severability: if any provision is invalid, the rest remain in force
• Waiver: failure to exercise a right does not waive it
• Assignment: you may not assign these Terms without our prior consent
